Terms & Conditions

These terms govern every purchase and every bid made through FineWyne. Please read them before you buy or bid — placing an order or a bid means you accept them.
1. Who we are
FineWyne is an independent merchant of fine wine, operated by [legal entity name — to be confirmed], registered at [registered address — to be confirmed], company registration [number — to be confirmed], VAT [number — to be confirmed].

2. Eligibility
We sell alcohol. You must be at least 18 years old (or the legal drinking age in your country of residence, if higher) to buy or bid. We ask for your date of birth when you create an account, and we may decline or cancel any order or bid where we cannot reasonably satisfy ourselves of your age.
We deliver within the European Union only.
3. Your account
- You need an account to check out or to bid. The details you give us must be accurate and kept up to date.
- You are responsible for keeping your sign-in credentials confidential; anything done under your account is treated as done by you.
- Bidding additionally requires bidder verification, which we grant at our discretion.
- You can close your account at any time from your account settings. Closing an account does not cancel outstanding orders or unpaid winning bids.
4. Buying from the catalogue
- Every bottle in our catalogue is a specific, individual bottle — one of one. Once it is sold, it is gone; orders are limited to one of each bottle.
- When you begin checkout, the bottle is held for you for a limited window (currently 45 minutes) while you complete payment. If payment is not completed in the window, the hold lapses and the bottle returns to sale.
- Your order is an offer to buy. The contract is formed when we confirm your order by email after successful payment.
- In the rare case that a payment succeeds but the bottle can no longer be allocated to you, we will refund you in full, automatically, to your original payment method.
5. Bidding in the saleroom
- Anyone can browse the saleroom; placing bids requires a verified account.
- Every bid is a binding offer to buy the lot at that amount. Bids cannot be withdrawn or reduced.
- Each lot shows the minimum next bid; bids below it are not accepted. Lots may carry a reserve — if the reserve is not met, the lot may not be sold.
- Lots close at the stated closing time. The highest valid bid at close wins, subject to any reserve.
- If you win, we invoice you at your winning bid amount and you must complete payment within the stated payment window (currently 24 hours). We will remind you before the window closes.
- If you do not pay within the window, the sale may be treated as defaulted and the lot re-offered. A late payment may still be accepted where the lot remains available, at our discretion.
6. Prices & payment
- All prices and bids are in euro (EUR).
- Payment is taken by card through Stripe's secure hosted checkout. We never see or store your card details.
- Delivery charges, where they apply, are shown before you confirm your order.
7. Delivery
- We deliver to addresses within the European Union.
- Delivery timescales and charges are [delivery terms — to be confirmed].
- Wine must be received by an adult. The carrier may ask for proof of age at the door and may refuse delivery where it cannot be provided.
- Risk in the bottles passes to you on delivery.
8. Cancellation & returns
Your cancellation and withdrawal rights, and how to exercise them, are set out in our Returns & refunds policy. Nothing in these terms affects your statutory rights.
9. Our liability
- Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
- Otherwise, our total liability to you in connection with any order or lot is limited to the amount you paid for it.
- We are not liable for losses that are not a foreseeable result of our breach of these terms. We supply wine for personal enjoyment, not investment; we are not liable for loss of anticipated value or profit.
10. General
- We may update these terms from time to time. The version published here when you place an order or bid is the one that applies to it.
- If any part of these terms is found unenforceable, the rest continues to apply.
- These terms are governed by the laws of [governing law & jurisdiction — to be confirmed], and disputes are subject to the courts there, without affecting mandatory consumer protections of the country you live in.
